What IPR and the PTAB Are

The Patent Trial and Appeal Board handles several proceedings. Learn what inter partes review examines and why institution differs from a final decision.

The Patent Trial and Appeal Board, or PTAB, is part of the USPTO. Its work includes appeals and certain proceedings that review issued patent claims.

What Inter Partes Review Examines

Inter partes review, usually shortened to IPR, is a proceeding to review the patentability of issued claims on specified grounds under sections 102 or 103, based on patents or printed publications. It is not a general trial of every issue that could arise in a patent dispute.

A Petition Is Not a Final Decision

A petition requests review. An institution decision determines whether the proceeding will begin under the applicable standards. A final written decision follows a different stage and addresses the challenged claims within the proceeding’s scope.

Those distinctions matter when reading a news report. “Review requested,” “review instituted,” and “claim held unpatentable” describe different events.

Read the Procedural Record

Dates, challenged claims, the decision type, and later review can all matter. Our Patent News collection is designed to link to primary records without offering opinions on the merits of pending cases.
